Dealer Specific Conditions
If you are trading as a dealer or trade customer, whether
or not for onward supply to a consumer, the following additional
terms and conditions apply to our standard terms and conditions
printed on all acknowledgements and invoices.
1. You acknowledge that you have read and
understood the document published by us entitled “Essential
information regarding stone surfaces”. This guide explains
amongst other things that stone is a natural substance that
may contain natural flaws, fissures and variations in its
colouring, strength, absorbency and its response to sealant.
2. Before making any onward sales of our
products you will ensure that your customer has read and understood
the “Essential information regarding stone surfaces”,
or your own specific company documents which should cover
the same limitations, ensuring that your contract with your
customer imposes no liability on you for defects attributable
to the natural characteristics of the materials supplied.
3. For the avoidance of doubt it is acknowledged
that the natural working characteristics of materials supplied
may in some rare situations result in small chips which arise
during the course of manufacture and installation, and we
not only reserve the right to replace or repair all such minor
defects entirely at our own discretion but also the right
to use chemical or resinous fillers, some of which may already
be present in the stone and it must be understood that small
defects do not constitute a failure by us to perform our contract
with you.
4. We are a customer oriented company that
prides itself on its services, but in trading with us, you
understand and agreed that UK Marble is not responsible for
dealing with your own customer complaints unless directly
attributable to UK Marble’s failure to perform its contract
with you.
5. If following installation a customer unreasonably
makes complaint and we assist you in the resolution of that
complaint by attending site and carrying out remedial work,
we reserve the express and explicit right to charge for dealing
with the situation and satisfying the end user.
